You must be at least the age of majority in your jurisdiction and able to enter a binding contract. You may not use the Services where prohibited by law. We may refuse service or close accounts at our discretion, including for fraud, abuse, or violations of these Terms.

GoKolla provides a platform where creators may participate in brand campaigns, compete on performance metrics, and interact with virtual balances or rewards described in the product ("K," gems, or similar). Features, availability, and rules may change. We do not guarantee uninterrupted or error-free operation.

You are responsible for account credentials and activity under your account. Notify us promptly of unauthorized use. You must provide accurate information and keep it current.

Specific campaigns may have additional rules, including eligibility, content requirements, judging or scoring methods, and prize details. Those rules are incorporated by reference. We may modify, suspend, or cancel campaigns or leaderboards. Rewards, withdrawals, or conversions of virtual value may be subject to verification, taxes, fees, minimums, and applicable law. We may withhold or reverse payouts in case of suspected fraud or breach.

You retain ownership of content you submit. You grant us a license to host, display, distribute, and use your content to operate and promote the Services, subject to product settings and applicable agreements with brands where relevant. You represent you have the rights to grant this license and that your content complies with our policies and the law.

You agree not to misuse the Services, including by scraping, attempting to manipulate metrics, harassing others, distributing malware, infringing intellectual property, or violating platform rules of third-party networks (e.g. TikTok, Instagram) when using our Services in connection with those networks.

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, neither GoKolla nor its suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims relating to the Services will not exceed the greater of amounts you paid us in the twelve months before the claim or one hundred U.S. dollars (USD 100), except where limited by law.

You will defend and indemnify GoKolla and its affiliates against claims arising from your use of the Services, your content, or your breach of these Terms, to the extent permitted by law.

We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. Continued use after changes constitutes acceptance unless otherwise required by law.
